Hunter Biden Seeks Dismissal of Cases Against Him

(RepublicanView.org) – Hunter Biden, the son of President Joe Biden, is seeking the dismissal of criminal cases filed against him in California and Delaware. A former drug addict who has been embroiled in multiple corruption scandals since his father entered the White House in 2021, the younger Biden is now looking to see criminal charges dismissed on the same basis that former President Donald Trump saw his criminal indictment dropped. According to Biden’s lawyers, both federal cases filed against him should be dismissed on the grounds that Special Counsel David Weiss, who was appointed during the Biden administration to oversee the cases, was illegally appointed in the same way that Special Counsel Jack Smith was found to have been illegally appointed for the Trump case.

Biden was hit with felony charges relating to his illegal purchase of a handgun in 2018 and further federal tax crime charges in California. He was convicted in the gun case back in June, and the tax trial is set to begin in September.

It’s important to note that Biden’s lawyers are not presenting new evidence to suggest that the cases against him are illegitimate in their content but are instead arguing that procedural issues mean the cases cannot legally go ahead. The same dynamic played out during the Trump criminal indictment saga, which was also prosecuted under Attorney General Merrick Garland’s time serving under President Biden. In Trump’s case, Judge Aileen Cannon ruled that Special Counsel Jack Smith’s appointment was unconstitutional, revealing that his appointment by Garland – and his lack of confirmation by the Senate – was not compliant with the Appointments Clause of the U.S. Constitution.

Biden could see success, but there could be a real legal battle ahead here. The Department of Justice is already looking to appeal the ruling, and spokespeople for Special Counsel Smith have publicly stated that they don’t believe his appointment is unconstitutional because previous cases have already confirmed that the Attorney General has the authority to appoint a Special Counsel.
